1. Acceptance
By using the White Heart Jewels website at whiteheartjewels.com, submitting an inquiry, or placing an order, you agree to these Terms and Conditions. If you do not accept them, please do not use the website or transact with us.
2. Trade-only business
White Heart Jewels is a wholesale supplier serving verified trade buyers only. We do not sell to consumers, do not operate retail accounts, and do not compete with the trade we serve. By placing an inquiry or order, you confirm that:
- You operate as a registered jewellery business in Canada or another recognised jurisdiction
- You are purchasing for resale, manufacture, or other trade use — not for personal consumption
- You are authorised to represent your business in this transaction
3. Trade verification
Before we accept your first order, we will request:
- A copy of your business registration or equivalent trade documentation
- Confirmation of your billing and shipping address
- Other reasonable verification, such as trade references, as we may determine
We reserve the right to decline to do business with anyone we cannot verify as a legitimate trade buyer.
4. Inventory and pricing
Inventory listed on our website is representative of our typical range. Actual stock, current per-carat pricing, and grade availability are confirmed at the point of quotation. Pricing is in Canadian Dollars (CAD), is subject to change, and is exclusive of HST and shipping unless otherwise stated. HST is added at invoice in accordance with Canadian tax law.
Our products are lab-grown diamonds (CVD or HPHT) supplied with parcel-level IGI mill report on request.
5. Quotes and orders
Quotes are valid for the period stated on the quote (typically seven days) and are not binding offers until confirmed in writing by both parties. Orders are accepted only when we issue a written order confirmation. We reserve the right to decline any order at our discretion.
6. Memo terms
Memo (consignment) parcels may be made available to established trade accounts at our discretion. Memo parcels remain the property of White Heart Jewels until purchased or returned. Specific memo terms — including value limits, return periods, insurance responsibilities, and reporting — will be agreed in writing for each memo transaction.
7. Sample policy
Sample parcels are available to verified trade accounts on request. Samples are billed at the agreed pricing. Where samples are sent on approval, return shipping is the buyer's responsibility unless otherwise agreed in writing.
8. Payment
Payment terms are agreed at the point of order. Default terms for new accounts are payment in advance or on delivery. Net terms may be available to established accounts on application. All payments are in CAD unless otherwise agreed.
9. Shipping and risk of loss
Stocked goods are shipped from our Greater Toronto Area location. Same-week dispatch is available for orders confirmed within agreed cutoff times. We use insured courier services; risk of loss transfers to the buyer on delivery to the courier. Shipping costs are added to the invoice unless otherwise agreed.
10. Returns
Memo parcels must be returned in the same condition as supplied, within the agreed memo period. Goods returned in different quantity or condition may be subject to charges.
For purchased goods, returns are accepted only for verifiable quality issues — for example, goods not matching the agreed grade or specification. Return requests must be made within seven (7) days of delivery. Custom-cut or custom-sized parcels are not eligible for return.
11. Intellectual property
The White Heart Jewels name, logo, website content, photography, and design are the intellectual property of White Heart Jewels and its licensors. You may not reproduce, distribute, or create derivative works from this content without our written permission.
12. Disclaimers
Lab-grown diamonds are subject to natural variation in colour, clarity, and dimensions within the stated grading tolerances. We do not warrant exact uniformity within a parcel beyond standard trade tolerances.
The website is provided "as is" without warranties of any kind, express or implied. We do not warrant that the website will be uninterrupted or error-free.
13. Limitation of liability
To the maximum extent permitted by law, our liability for any claim arising from your use of our website or our supply of goods is limited to the value of the specific transaction giving rise to the claim. We are not liable for indirect, consequential, or punitive damages.
14. Indemnification
You agree to indemnify and hold White Heart Jewels harmless from any third-party claim arising from your breach of these Terms or your misuse of our products or website.
15. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Any dispute arising from these Terms or our supply of goods shall be brought exclusively in the courts of Ontario.
16. Changes
We may update these Terms from time to time. The effective date at the top of this page indicates when the Terms were last updated. Continued use of our website after a change constitutes acceptance of the updated Terms.
17. Severability
If any provision of these Terms is held unenforceable, the remaining provisions will continue in full force and effect.
